Terms of Service
Important: BBerry provides information, monitoring tools, and access to automated trading activity operated through third-party cryptocurrency exchanges. We do not hold your funds, provide personalized investment advice, or guarantee any trading outcome. Crypto derivatives trading involves substantial risk of loss.
1. Who we are
These Terms of Service (“Terms”) govern your use of the BBerry websites and services, including bberry.uk, dash.bberry.uk, related dashboards, calculators, reports, and public updates (together, the “Service”). “BBerry”, “we”, “us”, and “our” refer to the operator of the Service.
2. Acceptance
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you copy-trade or follow trading activity through a third-party exchange, you are also subject to that exchange’s own terms, rules, and risk disclosures.
3. Eligibility
You may use the Service only if:
- you are at least 18 years old (or the age of majority where you live);
- you are legally permitted to access cryptocurrency derivatives and copy-trading services in your jurisdiction;
- you are not located in, or a resident of, a jurisdiction where such activity is prohibited; and
- your use of the Service complies with applicable laws and exchange rules.
You are responsible for determining whether copy trading or automated trading is lawful for you. We may restrict or discontinue access where required by law or platform policy.
4. What the Service provides
The Service may include:
- a web dashboard showing trading metrics, signals, regime context, reports, and historical summaries;
- links and instructions for following BBerry lead accounts on supported exchanges (such as Binance, Bybit, and OKX);
- educational or informational content, calculators, and performance summaries; and
- notifications and reports published through the Service or linked channels you choose to follow.
Unless we expressly state otherwise in writing, the Service does not include managed accounts, brokerage, custody, wallet services, or direct order execution on your behalf through BBerry.
5. No financial, legal, or tax advice
All content provided through the Service is for general information only. Nothing on the Service constitutes investment advice, financial advice, trading advice, legal advice, or tax advice. Past performance, backtests, calculators, and illustrative returns are not reliable indicators of future results. You should seek independent professional advice before making financial decisions.
6. Copy trading and third-party exchanges
If you choose to copy-trade or follow a lead account on a third-party exchange:
- your relationship for trading, custody, and funds is with that exchange, not with BBerry;
- you open and maintain your own exchange account and are responsible for KYC, security, and permissions;
- copy trading may replicate entries, exits, leverage, and position sizing automatically, which can amplify losses;
- exchange outages, liquidation, funding fees, slippage, and market gaps can cause losses beyond displayed estimates; and
- you can usually stop copying at any time through the exchange, subject to its interface and open positions.
We do not control exchange systems and are not responsible for exchange downtime, policy changes, delistings, rejected orders, or account restrictions imposed by an exchange.
7. Automated trading risks
Automated and algorithmic trading strategies can fail due to market conditions, connectivity issues, data errors, parameter changes, exchange rule changes, or software defects. You acknowledge that:
- you may lose part or all of the capital allocated to trading;
- leveraged derivatives can result in losses greater than your initial margin in some circumstances;
- high volatility may trigger stop-losses, liquidations, or rapid drawdowns; and
- reported metrics, dashboards, and notifications may be delayed, estimated, or incomplete.
8. Your responsibilities
You agree to:
- keep your exchange credentials, devices, and two-factor authentication secure;
- monitor your own account balances, margin, open positions, and copy-trading settings;
- use only capital you can afford to lose;
- not misuse the Service, attempt unauthorized access, scrape at abusive rates, or interfere with infrastructure; and
- provide accurate information if you contact us and not impersonate others.
9. Intellectual property
The Service, including branding, dashboards, text, graphics, software, and layouts, is owned by BBerry or its licensors and is protected by applicable intellectual property laws. You may view and use the Service for personal, non-commercial monitoring purposes unless we give written permission for another use. You may not copy, resell, reverse engineer, or commercially exploit the Service without consent.
10. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components.
11. Limitation of liability
To the fullest extent permitted by law, BBerry and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, trading losses, exchange account losses, or business interruption arising from or related to your use of the Service or reliance on any content, even if we have been advised of the possibility of such damages.
Where liability cannot be excluded, our total aggregate liability arising out of or relating to the Service is limited to the greater of one hundred US dollars (USD $100) or the amount you paid directly to BBerry for the Service in the twelve months before the claim, unless a higher mandatory limit applies under applicable law.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
12. Indemnity
You agree to indemnify and hold harmless BBerry and its operators from claims, losses, liabilities, damages, and reasonable expenses (including legal fees) arising from your breach of these Terms, your misuse of the Service, or your trading activity on third-party exchanges.
13. Suspension and termination
We may suspend or discontinue any part of the Service at any time, including for maintenance, security, legal compliance, or abuse prevention. You may stop using the Service at any time. Sections that by their nature should survive termination will continue to apply.
14. Changes
We may update these Terms from time to time. The “Last updated” date at the top will change when we do. Material changes may also be announced on the website. Continued use after changes become effective constitutes acceptance of the revised Terms.
15. Governing law and disputes
These Terms are governed by applicable law as determined by the operator of the Service and relevant mandatory consumer protections in your jurisdiction. Disputes should be resolved through the courts or dispute mechanisms required by applicable law.
